Flexible Fee Arrangements

Overview: This case study shows how Lewis Holdway Lawyers demonstrated good will in a case that many law firms would not consider taking on. Our client represented a number of creditors who were seeking reimbursement from a trustee of a bankrupt but asset-rich estate. Rather than adopting a hard-nose commercial approach, we produced the best possible outcome for our client by undertaking the work on a conditional fee basis.

Issue: When an asset-rich person went bankrupt, a number of creditors were left out of pocket. In seeking payment for these creditors, our client needed legal representation, but was worried about incurring hefty legal expenses that they would struggle to repay if the case was lost.

Actions: By taking the time to understand our client’s needs, we were able to offer assistance through a flexible fee arrangement. Rather than adding to our client’s financial worries, we commenced work on a conditional fee basis. Put simply, we proposed a fee schedule that was dependent on the outcome of the case.

Outcome: Lewis Holdway Lawyers achieved a good outcome with the case and the dividends of the estate provided returns for all creditors. Our client’s stress levels were significantly reduced and appropriate funds were provided to all parties.
